Conditions of Use Conditions of Use

1.

Application

1.1

These General Conditions apply to all offers, reservations and agreements relating to all accommodations sites and other facilities which are let by Rentals-Lanzarote ("Rentals-Lanzarote").

1.2

In these General Conditions, the term "renter" means: the person who makes an agreement with Rentals-Lanzarote regarding the rent/use of accommodation and/or camping place. The term "user" means: the renter and the persons specified by the renter who will make use of the accommodation and/or camping place and/or other facilities rented by the renter.

1.3

These General Conditions apply regardless of your (prior) reference to any own conditions or to other general conditions. Rentals-Lanzarote rejects all general conditions to which you refer or which you use.

1.4

Agreements which deviate from these General Conditions are only valid if they are agreed in writing. 

 

 

2.

Reservation

2.1

Rentals-Lanzarote will only deal with reservations made by persons 18 years or older. Reservation made by persons younger than 18 are not valid.

2.2

Rentals-Lanzarote reserves the right at all times - without stating reasons - to refuse to handle a reservation.

2.3

If Rentals-Lanzarote does handle your reservation, Rentals-Lanzarote will send you a digital confirmation, which will also be the invoice, within 2 days after the reservation is made. You must check the invoice for accuracy immediately after you have received it. Rentals-Lanzarote must immediately be informed of any inaccuracies.

2.4

If you do not have a digital confirmation/invoice within 2 days after the reservation is made, you must immediately contact your reservation office; if you fail to do so, you cannot make any claims on the basis of the reservation.

2.5

An agreement will be made between you and Rentals-Lanzarote when Rentals-Lanzarote has sent you the digital confirmation/invoice of your reservation.

2.6

The agreement relates to the letting of accommodations and/or other facilities for recreational use, which by its nature is short term.

 

 

3.

Changes in the agreement

3.1

If, after the agreement is made, you wish to make changes to the agreement, Rentals-Lanzarote is not obliged to accept such. It is at Rentals-Lanzarote  election to determine whether and to what extent it accepts such changes. In the event Rentals-Lanzarote does accept your changes, Rentals-Lanzarote can charge you alteration costs.

 

 

4.

Substitution

4.1

The company, the renter and other users are not permitted to allow persons other than those mentioned in the agreement to use the accommodation and/or camping place, howsoever called and under any heading whatsoever, unless otherwise agreed in writing with Rentals-Lanzarote.

4.2

If you and Rentals-Lanzarote have agreed that you and/or one or more users are to be replaced, you shall remain severally liable, in addition to the renter and/or users who replace you and/or other users, vis-à-vis Rentals-Lanzarote for the payment of the part of the rent still due, alteration costs (see Clause 3.1) and any extra costs resulting from the replacement and any cancellation costs.

 

 

5.

Prices

5.1

You owe Rentals-Lanzarote the agreed rent, as set out in the digital reservation confirmation / invoice. If the costs of Rentals-Lanzarote (personnel, electricity, taxes and the like) have demonstrably and unexpectedly increased after the agreement was made, Rentals-Lanzarote has the right to increase its prices and to charge you the increased price. If this price increase is implemented within 3 months after the agreement has been made, this price adjustment will be a maximum of 5% of the previously agreed price and you will have the right to dissolve (cancel) the agreement on that ground.

5.2

Price discounts and/or special offers can no longer be used if Rentals-Lanzarote has sent the reservation confirmation/invoice.

5.3

Insofar as applicable, all prices are inclusive of IGIC, unless otherwise stated. 

 

 

6.

Extra costs 

6.1

In addition to the rent, you/the renter also owe the administration costs which include reservation and handling costs, bed linen and tourist tax, including a contribution to other levies.

 

 

7.

Payments 

7.1

You must pay rent prices, increased by any costs, up to € 1000,- immediately upon reservation, in full. In the event the rent prices are more than € 1000,-, you must make a down payment of 40% with a minimum of € 500,- increased by the administration costs and insurance premiums. Payment of the aforementioned amounts must be made within 2 days after the date of the reservation

7.2

Rentals-Lanzarote must receive the remaining amount of the rent at latest 8 weeks before the day of commencement of the stay in Rentals-Lanzarote as set out in the reservation confirmation.

7.3

In the event of reservation within 8 weeks before the start of your stay the entire reservation amount must be paid in full at the time of reservation, or if you make a reservation by telephone, within 14 days after the date of the confirmation/invoice.

7.4

In the event of late payment of the amounts invoiced to you, you shall be immediately in default after the expiry of the payment term; Rentals-Lanzarote shall give you the option in writing to pay the due amount within 7 days. If payment is still not made, the agreement shall be deemed to have been dissolved (cancelled) as of the day the 7-day term has passed, and you shall be liable for all damage which Rentals-Lanzarote suffers or will suffer as a result hereof, including all costs incurred by Rentals-Lanzarote in connection with your reservation and the dissolution. Rentals-Lanzarote in any event has the right to charge cancellation costs per accommodation. In such case the provisions of Clause 13 apply.

7.5

Rentals-Lanzarote always has the right to set off claims on you, under any heading whatsoever, against monies paid by you, under any heading whatsoever. 

 

 

8.

Arrival and departure 

8.1

The rented accommodation can be taken into use on the agreed day of arrival as set out in the reservation confirmation as of 16.00 hours. On the agreed day of departure as set out in the reservation confirmation, the accommodation must be vacated before 12.00 hours.

8.2

If you wish to continue the agreement with Rentals-Lanzarote for longer than the agreed term and Rentals-Lanzarote agrees to such, Rentals-Lanzarote is at all times entitled to designate another accommodation.

8.3

If the use of the accommodation and/or other facility is terminated earlier than the agreed date, as set out on the reservation confirmation, the renter does not have any right to repayment of (a part of) the rent and/or costs, unless you have taken out cancellation insurance and meet the requirements laid down therein.

 

 

9.

Regulations

9.1

All guests must comply with the rules established by Rentals-Lanzarote for the parks, as laid down in, inter alia, the Park Regulations and the Swimming Pool Regulations. You can obtain these Regulations from the reception upon arrival.

9.2

In conformity with local by-laws, if so requested, ID must be produced when checking in. If the guests cannot show any ID, Rentals-Lanzarote may not and cannot accommodate the guests.

9.3

Every accommodation may only be inhabited by the number of persons stipulated in the brochure for the relevant accommodation.

9.4

If the restaurant, café and reception room facilities present in the park provide you with catering services or make catering agreements with you, such services and agreements are subject to the Uniform Catering Conditions. A copy of these Conditions can be obtained from the reception of the park upon request.

9.5

Rentals-Lanzarote reserves the right to make changes to the set-up and opening hours of the facilities of the parks. If necessary maintenance has to be carried out, you shall permit, without any right to compensation, that during your stay work to be carried out on the accommodation or other facilities.

9.6

For safety reasons it is not permitted to set up tents next to the accommodation.

9.7

The renter must leave the accommodation and/or camping place swept clean (i.e.: no dirty dishes, bed clothes removed and folded, kitchen and refrigerator clean, garbage bag in the container).

9.8

The renter and users are obliged to rent bed linen from Rentals-Lanzarote.

9.9

In the event of breach of the rules set out in these General Conditions, Park Regulations and/or Swimming Pool Regulations and/or Regulations, non-compliance with instructions of the personnel, Rentals-Lanzarote has the right to immediately remove you, the renter and every other user from the park, without repayment of the rent or any part thereof.

 

 

10.

Pets 

10.1

Rentals-Lanzarote permits the renter or users to bring a maximum of two pets per accommodation and/or camping place. If you and/or other users wish to bring along pets, you must state such when you make the reservation. In such case Rentals-Lanzarote will charge you a supplement, which you must pay. Rentals-Lanzarote reserves the right to refuse to allow to bring pets into the park, without having to state reasons.

10.2

Pets are not allowed access to ponds, swimming pools, restaurants, and other public areas in the park (unless otherwise indicated at a given area). Pets must be kept on a leash outside of the accommodation. Instructions on site must be followed. The pets may not cause a nuisance to the other guests.

10.3

A dog basket is compulsory, as is a flea collar for dogs/cats.

10.4

Animals in cages are free of charge (must be registered when making reservation).

10.5

Visitors are not allowed to bring pets.

10.6

If you cross the border with your pet then it is compulsory to have a European passport passport for the animal. Pets also have to be identified and vaccinated against rabies. Your vet can take care of this for you. To transport animals to countries within the EU, they have to be in possession of a passport in accordance with the European model (from 3 July 2004). Animals must be vaccinated against rabies and identification by means of a chip or tattoo is compulsory. You are personally responsibly for being in possession of the correct travel documents required for your destination.

 

 

11.

Breakage, loss 

11.1

The renter, as set out on the reservation confirmation, is responsible, without prejudice to the responsibility or liability of the other users/guests, for an orderly conduct in and around the rented accommodation and/or camping place or elsewhere in the park, insofar as such is influenced by the renter or his party/the other user.

11.2

In addition the renter is always liable, without prejudice to the liability of other users, for damage caused by breakage and/or loss and/or damage of inventory and/or accommodation. The renter must immediately report any damage to Rentals-Lanzarote and must immediately compensate such on site, unless the renter can demonstrate that the arising of the damage is not attributable to the renter, other users or one of the members of his party.

 

 

12.

Deposit 

12.1

At the start of your stay Rentals-Lanzarote can demand that you pay a deposit of € 500,- per accommodation. In the event the deposit is not paid immediately, Rentals-Lanzarote is entitled to deny the renter and/or other users access to and the use of the accommodation and/or the camping place.

12.2

If you fail to pay the deposit, Rentals-Lanzarote is, moreover, entitled to dissolve (cancel) the agreement with immediate effect.

12.3

The deposit, or any remainder thereof after payment of any claims which Rentals-Lanzarote has on the renter and/or users, shall be repaid if you leave the accommodation in proper condition, in accordance with the provisions of Clause 9. Such repayment shall not affect any claims to compensation.

 

 

13.

Cancellation costs

13.1

If a reservation is cancelled, cancellation costs are owed. The cancellation costs are: cancellation up to 28 days before the day of arrival, 20% of the total costs and in the event of cancellation as of the 28th day till 10th before arrival, 50% the total costs/agreed rent as of cancellation as of the 28th day before arrival or later, the total costs/agreed rent.

13.2

If you have not arrived within 24 hours after the agreed date without notice, this shall be deemed to be a cancellation.

 

 

14.

Advance reservation

14.1

There is the option of making a preliminary reservation for the next year. The renter must make a deposit of € 30,-, which deposit can be set off against the final amount. If the preliminary reservation is not converted into the final reservation, the deposit shall be repaid. 

 

 

15.

Force majeure and changes

15.1

In the event Rentals-Lanzarote is not able to perform the agreement, in whole or in part, temporarily or otherwise, due to force majeure, it shall present you with a change proposal (for other accommodation/another time, etc.) within 14 days after it has become aware of the impossibility of performing the agreement.

15.2

There shall be force majeure on the part of Rentals-Lanzarote if the performance of the agreement is hindered, in whole or in part, temporarily or otherwise, by circumstances beyond the control of Rentals-Lanzarote, including war risk, personnel strikes, blockades, fire, floods and other disruptions or events.

15.3

You are entitled to reject the change proposal. If you reject the change proposal, you must give notice of such within 14 days after receipt of the change proposal. In such case Rentals-Lanzarote has the right to dissolve the agreement with immediate effect. You are then entitled to waiver and/or return of (the part of) the rent already paid. In such case Rentals-Lanzarote shall not be bound to pay compensation for any damage.

 

 

16.

Termination 

16.1

Rentals-Lanzarote is at all times entitled to terminate the agreement with immediate effect, if when making the reservation your personal details and/or the personal details of other users are incomplete and/or inaccurate. In such case there will be no repayment of the rent or a part thereof.

 

 

17.

Liability

17.1

Rentals-Lanzarote does not accept any liability for theft (including theft from bungalow safes and swimming pool lockers), loss of or damage to goods or persons, of any nature whatsoever, during or as a result of a stay in one of our parks and/or the rent/the use of accommodation and/or camping place and/or other facilities of Rentals-Lanzarote, unless there is intent or gross negligence on the part of Rentals-Lanzarote or (one of) its employees.

17.2

Liability for damage consisting of loss of travel enjoyment or trading loss and other consequential damage, is excluded under all circumstances. Rentals-Lanzarote is furthermore in no event liable for damage for which there is a claim to compensation under the heading of travel and/or cancellation insurance or any other insurance.

17.3

Rentals-Lanzarote is not liable for disruptions in the service or defects in services provided by third parties.

17.4

Liability on the basis of wrongful act is in any event limited to a maximum of € 3,500,- for personal accidents per guest per stay and liability for material damage is in any event limited to a maximum of € 5,500,- per renter/user per stay.

17.5

You are severally liable together with the user for all loss and/or damage to the rented accommodation and/or camping place and/or other property of Rentals-Lanzarote, arising during the use thereof by your and/or other users, regardless of whether this is the result of actions or omissions of yourself and/or of third parties who are in the park with your permission.

17.6

You indemnify Rentals-Lanzarote against all claims relating to damage of third parties which are (partly) the result of any action or omission of yourself, other users, your travel companions or third parties who are in the park with your permission.

17.7

In the event of incorrect use or failure to leave the accommodation in good condition, including but not limited to excessive untidiness, extra costs will be charged, which you will then be obliged to pay immediately.

 

 

18.

Internet

18.1

This website and our brochures have been made with the greatest attention and care for the accuracy of the information contained herein. However, Rentals-Lanzarote cannot be held responsible for any inaccuracies and/or changes made at a later time. Apparent typing errors do not bind us. Price changes are reserved.

18.2

Our website can contain links to other websites. Rentals-Lanzarote cannot be held responsible for the contact or use of these sites, or for the possible consequences of visiting such a site.

18.3

You may link your site to our site at any time. That is what internet is all about. However we do appreciate you informing us about this.

 

 

19.

Complaints

19.1

Despite the care and the efforts of Rentals-Lanzarote you might be of the opinion that you have a justified complaint with regard to your holiday accommodation. In the first instance, you must lodge this complaint directly and on site to the management of the park where your accommodation is located. Should the complaint not be dealt with to your satisfaction, then up to a maximum of 1 month after departure from the park where you stayed, you can lodge your complaint in writing with: Rentals-Lanzarote, Guest Services department, Rozesteinweg 6  6957BJ Laagsoeren the Netherlands. The complaint shall then be handled with due care. Should this also fail to lead to a satisfactory solution, you have up to a maximum of 3 months after departure from the park to lodge the complaint with the Recreation Dispute Committee in The Hague or to bring the complaint before the court which has jurisdiction under the law. The decision of this committee has the force of a binding advisory opinion.

 

 

20.

Applicable law

20.1

The agreement between yourself and Rentals-Lanzarote is exclusively governed by Dutch and/or Spanish law.

 

 

21.

Travel documents

21.1

You are personally responsible for being in possession of the valid travel documents required for your destination. Rentals-Lanzarote accepts no liability for any consequences ensuing from your not being in possession of the correct travel documents.

 

 

22.

General

22.1

Apparent printing and typing mistakes do not bind Rentals-Lanzarote All previous publications are cancelled by these General Conditions.

22.2

All data which you give to us will be recorded in a database. The information you give us will be recorded in a file. This file is registered with the Dutch Data Protection Authority in The Hague. The database will be used for our guest administration. These data can also be used to provide specific information and offers on our products and services, either from third parties or us. In order to align this information and these offers to your interest as much as possible, we can combine your data with data held by other companies.
